Yes. Section 33 of the Legal Practice Act 28 of 2014 reserves particular functions to admitted practitioners: appearing in court, and drawing up documents for use in legal proceedings. Contract drafting, legal research, opinions and advisory work are not reserved.
The Gauteng High Court considered exactly this in Damons N.O. and Another v Bezuidenhout (Case No. 121475/2024) [2025] ZAGPPHC 820. Reading section 33(1)(b) together with section 33(3), Millar J held that drawing up draft documents is not reserved in law to practising legal practitioners, and that a consultant who does not hold himself out as one does not contravene the section. The fees paid to him for that work were not set aside.
